Last updated: May 2023

Section two of Article 22 of Spanish Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce (hereinafter, LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (hereinafter, GDPR), and Organic Law 3/2018 of 5 December, on Data Protection and the Guarantee of Digital Rights (hereinafter, LOPDGDD), establishes that:

  • Service providers may use data storage and retrieval devices on the terminal equipment of recipients, provided that they have given their consent after having been given clear and complete information about their use, in particular about the purposes of the data processing, in accordance with the provisions of personal data protection legislation.
  • Where technically feasible and effective, the recipient’s consent to accept data processing may be given by using the appropriate settings of the browser or of other applications.
  • The foregoing shall not prevent any technical storage or access for the sole purpose of carrying out the transmission of a communication over an electronic communications network or, to the extent strictly necessary, for the provision of an information society service expressly requested by the recipient.

The GDPR, in its recital 30, mentions these technologies and their impact on data protection, stating that natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols, such as internet protocol addresses, session identifiers in the form of "cookies" or other identifiers such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of natural persons and identify them.

This cookie policy has been reviewed in accordance with the new rules on the use of cookies published by the Spanish Data Protection Agency (AEPD) on 28 July 2020, amending the Guide on the use of cookies to bring it into line with the Guidelines on consent amended in May 2020 by the European Data Protection Board (EDPB) (Guidelines 05/2020) on consent. Specifically, it has taken the technical measures to ensure that the "continue browsing" option is not configured as a means of obtaining consent, and that no "cookie walls" are in place.

In compliance with the established legislation, we set out below the information relating to the "cookies" used.

Information about the use of cookies

We inform you that this website you have accessed uses first-party and third-party cookies to offer you a better experience and service. By browsing or using our services, the user does not accept our use of cookies; rather, their consent is collected expressly, and without their browsing ability being blocked if they refuse.

Cookies used for any of the following purposes are exempt from compliance with the obligations established in Article 22.2 of the LSSI:

  • Solely to enable communication between the user’s equipment and the network.
  • Strictly to provide a service expressly requested by the user.

What is a cookie

"Cookies" are small files that some platforms, such as websites, may install on your computer, smartphone, tablet, connected television, etc., when you access them. Their functions can be very varied: storing your browsing preferences, gathering statistical information, enabling certain technical functionalities, and storing and retrieving information about a user’s or their equipment’s browsing habits or preferences, to the point, at times, depending on the information they contain and the way you use your equipment, of being able to recognise it. A cookie is stored on a computer to personalise and make the user’s browsing as easy as possible. Cookies play a very important role in improving the experience of using the website.

In other words, a cookie is a piece of information sent by a website and stored in the user’s browser, so that the website can consult the user’s previous activity. A cookie does not identify a single person, but may incorporate a combination of computer-browser-user.

What the website uses cookies for

Cookies are used to distinguish between users and to act differently depending on them. One use of cookies is to log in to a website. Users normally log in by entering their credentials on a validation page; cookies allow the server to know that the user is already logged in or browsing the website, and so they can be allowed to access services or carry out operations that are restricted to users who are not logged in.

Why are they important?

  • From a technical point of view, they allow websites to work more smoothly and adapted to users’ preferences, such as storing the language, the country’s currency or detecting the access device.
  • They establish levels of protection and security that prevent or hinder cyberattacks against the website or its users.
  • They allow the managers of the media to access statistical data collected in the cookies in order to improve the quality and experience of their services.
  • They serve to optimise the advertising we show to users, offering that which best matches their interests.

Types of cookies

Depending on which entity manages the equipment or domain from which the cookies are sent and processes the data obtained, we can distinguish:

First-party cookies: these are those sent to the user’s terminal equipment from equipment or a domain managed by the publisher itself and from which the service requested by the user is provided.

Third-party cookies: these are those sent to the user’s terminal equipment from equipment or a domain that is not managed by the publisher, but by another entity that processes the data obtained through the cookies. Where the cookies are served from equipment or a domain managed by the publisher itself, but the information collected through them is managed by a third party, they cannot be considered first-party cookies if the third party uses them for its own purposes (for example, improving the services it provides or providing advertising services on behalf of other entities).

Depending on the purpose for which the data obtained through the cookies is processed, the website may use:

Technical cookies: these are those that allow the user to browse a website, platform or application and to use the different options or services available on it, including those that the publisher uses to enable the management and operation of the website and to enable its functions and services.

Preference or personalisation cookies: these are those that allow information to be remembered so that the user accesses the service with certain characteristics that may differentiate their experience from that of other users, such as the language, the number of results to display when the user carries out a search, the appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which they access the service, etc.

Analytics or measurement cookies: these are those that allow the party responsible for them to track and analyse the behaviour of the users of the websites to which they are linked, including the quantification of the impacts of advertisements. The information collected through this type of cookie is used to measure the activity of the websites, application or platform, in order to introduce improvements based on the analysis of the usage data made by the users of the service.

Behavioural advertising cookies: these are those that store information on users’ behaviour obtained through the continuous observation of their browsing habits, which makes it possible to develop a specific profile in order to display advertising based on it.

According to their expiry, the cookies used may have the following types of expiry:

Session cookies: these are those designed to collect and store data while the user accesses a website. They are usually used to store information that is only of interest to retain for the provision of the service requested by the user on a single occasion (for example, a list of purchased products) and they disappear when the session ends.

Persistent cookies: these are those in which the data remains stored on the terminal and can be accessed and processed for a period defined by the party responsible for the cookie, which may range from a few minutes to several years. This website uses both temporary session cookies and permanent cookies.

In some cases, if any of these cookies are disabled, you will not be able to receive our contents and services correctly. On other occasions, the website may continue to function. In any case, we would like to make you aware that the information captured by these cookies about the use of our website and about the success of the advertisements shown on it allows us to improve our services.

There are no data transfers to third countries.
Cookies are not used for profiling.

How to disable cookies in the main browsers

You can allow or block cookies, as well as delete your browsing data (including cookies), from the browser you use. Consult the options and instructions offered by your browser to do so. Please note that if you accept third-party cookies, you will need to delete them from the browser options.

It is possible to stop accepting cookies from the browser, or to stop accepting cookies from a particular service.

Modern browsers allow you to change the cookie settings. These settings are normally found in the 'Options' or 'Preferences' of your browser menu. You can also configure your browser or your email client, as well as install free add-ons to prevent Web Bugs from being downloaded when you open an email.

The user may, at any time, choose which cookies they want to operate on this website through the browser settings; for example:

  • Chrome: Settings → Show advanced settings → Privacy → Content settings. For more information, you can consult Google support or the browser help.
  • Edge / Internet Explorer: Tools → Internet Options → Privacy → Settings. For more information, you can consult Microsoft support or the browser help.
  • Firefox: Tools → Options → Privacy → History → Custom settings. For more information, you can consult Mozilla support or the browser help.
  • Safari: Preferences → Privacy. For more information, you can consult Apple support or the browser help.
  • Opera, Android and other browsers: consult the documentation of the browser or system itself.

You can also use other third-party tools, available online, that allow users to detect the cookies on each website they visit and manage their deactivation.

The company is in no case responsible for the content and accuracy of the privacy policies of the third parties included in this cookie policy.

Acceptance of cookies

We are grateful for your consent to accept cookies; this helps us obtain more accurate data that allows us to improve the content and design of our websites and applications in order to tailor them to your preferences.

Should the Company provide any kind of special service in which it sets out specific provisions different from these regarding the protection of personal data and the use of cookies, the particular rules indicated for that specific service will prevail over the present ones, and will in any case obtain the user’s consent.

Do we update our cookie policy?

We may update the cookie policy of our Website, among other things in response to legislative or regulatory requirements, or in order to bring this policy into line with the instructions issued by the Spanish Data Protection Agency. We therefore recommend that you review this policy each time you access our Website in order to be properly informed about how and why we use cookies. In relation to the use of personal data, you can consult our privacy policy, as required by the GDPR.

If you have any questions about this cookie policy, you can contact us at the email address lopd@brandcrops.com.
